Article 1 - Length of stay:
A tenant who has booked for a fixed period may not, under any circumstances, claim any right to remain in the property at the end of the stay.
Article 2 - conclusion of the contract :
a) The reservation becomes effective once the owner has received the deposit of 50% of the total amount of the reservation. The deposit will be debited from the account authorised by a prepayment procedure 14 days before arrival.
b) The rental agreed initially between the parties may under no circumstances be transferred to third parties, whether natural or legal persons, without the written agreement of the owner.
Any breach of this last paragraph will result in the immediate cancellation of the rental to the detriment of the Tenant, with the proceeds of the rental remaining the property of the Owner.
Article 3 - No right of withdrawal :
For bookings made by post, e-mail, telephone or online, the Tenant does not benefit from the withdrawal period, in accordance with article L121-21-8 of the French Consumer Code relating in particular to the provision of accommodation services supplied on a specific date or at a specific time.
Article 4 - Cancellation by the tenant:
All cancellations must be notified to the owner in writing (by e-mail or instant messaging).
A cancellation request made more than 14 days before the arrival date will not incur any financial penalty.
Any request for cancellation made within 14 days of arrival will incur a charge of 50% of the total cost of the stay.
a) If the tenant does not show up within 24 hours of the arrival date indicated on the contract, the present contract becomes null and void, the owner may dispose of the gîte and the total payment initially stipulated in the contract is due.
b) If the stay is cut short, the rental price is retained by the owner. No refund will be made.
c) During a health crisis, if a national travel ban is in force, the customer may cancel the booking without penalty. The deposit will, at the customer's discretion, be refunded or retained by the owner in the form of a credit note for a future stay.
Article 5 - Cancellation by the owner :
a) Cancellations made more than 14 days before the arrival date will not incur any financial penalty. In this case, if a deposit has been paid, it will be refunded.
b) The owner may also cancel a rental if the bank card used for prepayment is no longer valid at the time the deposit is taken 14 days before arrival.
Article 6 – Arrival:
The tenant must arrive on the day and at the time specified in the booking conditions. In the event of late or delayed arrival, the tenant must inform the owner in advance.
Article 7 - Payment of the balance :
The balance of the rental, if applicable, must be paid on entry to the gîte. The tourist tax must also be paid if it has not been collected beforehand.
Article 8 - Inventory of fixtures :
a) The gîte is deemed to be in an irreproachable state of cleanliness on the tenant's arrival. The tenant is responsible for cleaning the premises during the rental period. The digital version of the welcome folder distinguishes between what is the responsibility of the Tenant and what is the responsibility of the Owner.
All appliances and accessories in the gîtes are declared to be in perfect working order.
b) Any report relating to the state of the premises, the state of the accommodation and its equipment during a rental must be submitted in writing (by e-mail or instant messaging), to the owner, within two days of entering the premises.
Article 9 - Security deposit :
On the tenant's arrival, a security deposit of 400€ is requested by the owner in the form of a bank imprint from a credit card (pre-authorisation) or by cheque. This will be returned by post within 8 days of departure. In the event of loss or damage to any part of the gîte caused by the tenant, the amount of this deposit will be reduced, before it is returned, by the cost of restoring it to its original state and/or the cost of replacing it, as evidenced by an invoice.
Article 10 - Use of the premises :
The tenant must ensure the peaceful nature of the accommodation and use it in accordance with the intended purpose. Under no circumstances may the gîtes be used as a venue for a festive event without the prior written agreement of the owners.
Article 11 - capacity :
This contract is drawn up for a maximum capacity of people. If the number of guests exceeds the capacity of the gîte, the owner may refuse to accept additional guests. If he accepts them, an additional charge will be applied.
Article 12 – Pets:
Pets are not allowed in the gîtes. In the event of non-compliance with this clause, the owner may refuse the stay and no refund will be made.
Article 13 - Insurance :
The tenant is responsible for all damage caused by him/her. He must be covered by an insurance contract for these various risks.
